Thank you for purchasing your Mixing It Up Painting Events ticket! We hope this will be a night you won't forget and will be talking about for a while! These are the terms and conditions that govern your use of the Mixing It Up Painting Events service, including all features of the Mixing It Up Painting Events website, the user experience and all content associated with our service.

Having made a booking you are deemed to have accepted and agree to be bound by our Terms and Conditions set out below.

Definitions

All references to "You" and “your” means the person accessing or using the website to purchase a ticket for yourself or others who will eventually utilise the ticket to attend the event.

All references to "We”, “our" and "us" refers to Mixing It Up Painting Events.

We reserve the right to change and/or modify all or any part of these terms and conditions at any time and without notice.

How the Mixing It Up Painting Events service works

Mixing It Up Painting Events provides a unique entertainment event for you and your friends or loved ones. You buy a ticket online for an event and we arrange all of the tools of the trade for you to participate in a 2 hour guided painting experience at a restaurant or bar.

Online payments and pricing:

All pricing is in New Zealand Dollars and includes GST. Pricing may be changed at our discretion and without notice. All credit cards are charged in New Zealand Dollars. All services listed on the website, their information, and their prices are each subject to change. We reserve the right to change, suspend, or discontinue the sale of any services with or without notice at any time.

Payment Terms:

We only reserve seats once we have received payment in full. Food and beverages are excluded from the seat price & can be purchased from our venues throughout the event. ( Unless you purchase an early bird ticket - which currently includes one house beer or wine).

We give you Credit Tickets not Refunds:

If an acceptable unforeseen circumstances can be proven in writing with 48-hour notice a credit ticket can be issued to attend another session if you cannot attend the booked session - valid for one month only, from the session date
We do not issue refunds.

No shows will not be refunded or rescheduled.

Delay or Cancellation of Events:

We make every effort to start events on time; however delays are occasionally inevitable due to events beyond our control which may cause the commencement of a class to be delayed or a class cancelled altogether.

If a class is delayed by more than 1 hour or is cancelled during its scheduled event time, we will provide you with a credit ticket for another event. If an event is cancelled prior to the class starting, we will notify you as soon as practically possible and provide an alternative class.

We do not issue refunds, and will reschedule your booking for an alternative date that you are available to join us.

Promotions:

Promotion codes cannot be used in conjunction with any other offer or code.

Clothing:

We do supply aprons to assist in protecting your clothing but we take no responsibility for any straying paint drops. It is your responsibility to ensure your clothing is adequate for the task.

We use easy to clean water soluable paint to assist with easy removal of any paint accidents!

Copyright:

Our demonstration and display paintings are our artists property and for your private use only.

Legal Requirements:

We are subject to all regulations and New Zealand laws including:

-Health and Safety Act 1992: Referring to "Provisions of Facilities and General Safety and Health in commercial premises".
-The Fair Trading Act 1986
-Sale and Supply of Alcohol Act 2012
-Privacy Act 1993
-Consumer Guarantees act 1993

Privacy Act:

We are subject to the provisions of the Privacy Act 1993.

We will hold in confidence all personal information (i.e. phone numbers and email addresses) concerning you, acquired in the course of performing our Services. We will not, without your prior consent, disclose any of this information to any other party except in the ordinary course of performing our Services and as required by law.

Please Note: Photos taken of you during our events can be used in any marketing material or social media marketing for our business.

Intellectual Property Rights
We hold all copyright and other intellectual property rights in the website and all content on the website, unless the content is identified as being the property of another party. This includes graphics, logos, images, text and website design.

Governing Law
The website is governed by the laws of New Zealand. When you access the website, you submit to the exclusive jurisdiction of the New Zealand courts.

Accessing the website and its content
The website (and its content) is provided on an "as is" and "as available" basis. We reserve the right to withdraw or amend the website at any time and do not guarantee that the website will be available to you at any time. We will try to make sure that the information on the website is accurate and up-to-date, but do not guarantee that the content is reliable, accurate, or suitable for what you may want to use it for.


Exemption or Limitation from Liability Where Permitted By Law
We will not be liable for any loss or damage (direct or otherwise) you suffer in connection with your use of the website or of any linked website or your use of, or reliance on, content contained on or accessed through the website or any linked website. We also exclude any condition or warranty that could be implied into these terms.

Except in the event of willful default or dishonesty by us, you indemnify us from and against all actions, claims, demands, losses, costs, damages and expenses (including, without limitation, reasonable legal costs on a solicitor/client basis) incurred by us as a direct or indirect result of supplying our product and services.

If we are liable to you, whether in contract or otherwise, that liability will only extend to any direct loss or damage suffered by you as a result of a breach by us of our obligations to you. And Subject always to New Zealand Law.


Security
Information transmitted over the internet is inherently insecure. However, we have physical, electronic and managerial processes in place to protect the information we collect via our website. Any information sent through the website is passed through a secure server using encryption technology. All stored customer data is protected with secure passwords, user log-ons and other security procedures.


Disputes
In the event that of a dispute you must immediately notify us giving details of the dispute. You agree we are acting in good faith and will then endeavour to resolve the dispute. In the event the dispute or difference cannot be agreed to, we agree that a mediator will be appointed. If the dispute is not settled by mediation within 30 working days of service of notice of the dispute by any party, or such further period as the parties agree in writing, the dispute shall be referred to and finally resolved by arbitration.

Severable
If any of these Terms and Conditions are held to be invalid, void, unenforceable or illegal for any reason, such provision shall be deemed to be severed from these Terms and Conditions and the remaining Terms and Conditions shall continue in full force

PRIVACY POLICY

In this policy:
"You" and “your” means the person accessing or using the website. "We", “our” and “us” refers to Mixing It Up Painting Events. We reserve the right to change and/or modify all or any part of this policy at any time and without notice.

By registering for a Mixing It Up Painting event you agree and consent to us collecting your contact information (name, email, phone numbers, etc.) as a way to communicate with you regarding the session registration and any upcoming events or promotions.

We do not share or use this information in any other way or with any outside parties.

Also, by registering and attending an event with us, you consent to pictures being taken of you during the class and for them to be used for promotions or advertising of the business (i.e. Facebook, and other social media)

The Mixing It Up Painting Events website is a secure site and all online payments are processed by a secure bank approved system. We do not keep your credit card details.
